Ein Libyer ist am 5. Oktober von US-amerikanischen Streitkräften in Libyen festgenommen worden und wird seither ohne Kontakt zur Außenwelt in US-Militärgewahrsam gehalten und verhört. Vor einem Bundesgericht der USA läuft wegen mutmaßlicher Verbindungen zu Al-Qaida und der Beteiligung an den Anschlägen auf die US-Botschaften in Kenia und Tansania im August 1998 ein Strafverfahren gegen ihn. Bei einer Verurteilung droht ihm die Todesstrafe.

Eine Spezialeinheit der US-Streitkräfte hat am 5. Oktober Nazih Abdul-Hamed al-Ruqai, bekannt unter dem Namen Abu Anas al-Libi, auf einer Straße der libyschen Hauptstadt Tripolis festgenommen. Angehörige teilten Amnesty International mit, dass er gegen 6.30 Uhr festgenommen wurde, als er auf dem Rückweg vom Morgengebet in einer nahegelegenen Moschee seinen Wagen vor der Tür seines Hauses parken wollte. Er wurde von etwa sieben Männern festgenommen, die mit Handfeuerwaffen in zwei gepanzerten Fahrzeugen bei ihm zu Hause vorfuhren. Ein drittes gepanzertes Fahrzeug parkte in etwa 15 Meter Entfernung. Nach Angaben der Familienmitglieder, die die Entführung beobachten konnten, waren einige der Männer maskiert und sprachen libysches Arabisch. Die Familie wurde bislang weder von den libyschen noch von den US-Behörden offiziell über die Inhaftierung oder den Verbleib von Abu Anas al-Libi informiert.

Die USA haben bestätigt, dass sich Abu Anas al-Libi in US-amerikanischem Militärgewahrsam befindet. In einer Pressemitteilung vom 6. Oktober gab das Pentagon bekannt, dass die Operation unter Befehl des US-Militärs durchgeführt und von "Präsident Obama genehmigt" worden sei und dass Abu Anas al-Libi nun "an einem sicheren Ort außerhalb Libyens unter Kriegsrecht rechtmäßig inhaftiert" sei. Berichten zufolge befindet er sich derzeit an Bord der USS San Antonio und könnte dort mehrere Wochen festgehalten werden.

Das Entführungsverbot im internationalen Recht gilt ausnahmslos. Davon darf auch in Notsituationen, die das Überleben einer Nation bedrohen können, nicht abgewichen werden. Es darf auch niemandem willkürlich die Freiheit entzogen und nicht von den Grundprinzipien für faire Gerichtsverfahren abgewichen werden, dazu gehört der Grundsatz der Unschuldsvermutung. Verschleppungen dieser Art, gefolgt von Verhören in Haft ohne Kontakt zur Außenwelt, unterhöhlen die Unschuldsvermutung. Zu Verhörmethoden, die nach Anhang M des US-Armee-Feldhandbuchs in solchen Fällen genehmigt werden können, gehören Isolation des Gefangenen über einen längeren Zeitraum hinweg sowie Schlafentzug und -unterbrechung. Einen Menschen über einen längeren Zeitraum ohne Kontakt zur Außenwelt in Haft zu halten, kann eine grausame, unmenschliche oder erniedrigende Behandlung darstellen.

The USA responded to the 11 September 2001 attacks by invoking a "global war on terror" against al-Qa'ida and other groups in which international human rights law would not apply. Although the Obama administration dropped some of its predecessor's language - such as "war on terror" and "enemy combatant" - it broadly adopted the global war framework. The USA has long resorted to abduction to gain custody over certain suspects, and this practice predated the 9/11 attacks, although the USA's response to those attacks included adapting the practice of "rendition" to send individuals to interrogation by agents of other countries (see

it has usually been other US government agencies, such as the FBI or the CIA, leading the abduction. In this case, it was the military, authorized by President Obama in his role as Commander in Chief of the Armed Forces, which led the operation, conducted under the USA's flawed "global war" framework. His interrogation is likely being carried out by the "High Value Detainee Interrogation Group", made up of personnel from different US agencies, including the CIA, FBI and Defense Intelligence Agency.

On 6 October US Secretary of Defense Charles Hagel confirmed that Abu Anas al-Libi is "now in US custody" and recalled that he "was designated as a global terrorist by Executive Order, was a subject of the US Rewards for Justice Program, and is on the UN Al Qaeda sanctions list. He was also indicted for his alleged role in the 1998 US embassy bombings in Africa, and other plots to conduct attacks against US interests." On 7 October, the State Department spokesperson said that Abu Anas al-Libi would not be transferred to Guantánamo as the administration's "policy is not to send any new detainees to Guantánamo".

HINTERGRUNDINFORMATIONEN AUF ENGLISCH - FORTSETZUNG

Abu Anas al-Libi was indicted in 1998 in the US District Court for the Southern District of New York (a superseding indictment was filed in 2000). He is charged among other things with involvement in the August 1998 bombings of two US embassies in Kenya and Tanzania in which 224 people were killed and many more injured. Some of the charges potentially carry the death penalty. Amnesty International has long called for anyone responsible for this and other such attacks on civilians to be brought to justice, without resort to the death penalty, and for the USA to comply with international human rights principles in so doing.

The case of Somali national Ahmed Abdulkadir Warsame, who was detained by US forces in the Gulf of Aden on or about 19 April 2011 heightens concerns in the al-Libi case. Warsame was apparently held in secret detention for at least two weeks and incommunicado for at least six weeks before he was transferred to New York in early July 2011 and charged with terrorism-related offences. The US authorities responded to Amnesty International's concern about his pre-transfer treatment by saying that "the US Government has consistently asserted that it is at war with al Qaida and its associated forces, and that it may take all lawful measures, including detention, to defeat the enemy".

In a statement issued on 6 October, the office of Libyan Prime Minister Ali Zeidan said it was seeking clarification from the US authorities concerning the abduction, stressing its willingness to prosecute Libyan citizens in Libya regardless of the charge, and emphasizing the presumption of innocence. While the Libyan government stressed it would follow up with the US authorities in accordance with applicable laws and human rights principles, it also highlighted the strategic relationship between the two countries in the area of security and defence. In this particular case, the abduction of Abu Anas al-Libi also undermines Libya's efforts to establish the rule of law at a time when the country is in need of international support to rebuild its institutions significantly weakened by the 2011 armed conflict.

In addition to the possible pursuit of the death penalty against him, there may be other concerns about Abu Anas al-Libi's treatment if he is transferred to the USA for trial. Inmates in pre-trial detention in the federal system have been held in cruel conditions of solitary confinement. For example, detainees in the Special Housing Unit of the federal Metropolitan Correctional Center (MCC) in New York City, the facility where he would likely be held if transferred to New York for trial, have been confined for 23 to 24 hours a day to small solitary cells with the windows painted over and little access to natural light or fresh air.
